These Terms and Conditions govern your use of the Smaacaad website and any purchase of our NFC cards, NFC stands, digital profiles, programming, customization, and related services. By using the website or placing an order, you agree to these terms.

1. Who we are

Smaacaad operates from Dubai, United Arab Emirates. Unless the context requires otherwise, "Smaacaad", "we", "our", and "us" refer to the business operating this website and supplying the relevant product or service.

2. Eligibility and acceptable use

• You must be legally able to enter into a binding agreement to use our website or place an order.
• You agree not to use our website, products, or services for any unlawful, fraudulent, abusive, or infringing purpose.
• You may not interfere with website security, upload malicious code, scrape restricted content without permission, or misuse our forms, checkout, or support channels.

3. Product information and custom orders

We aim to describe products, pricing, lead times, and features as accurately as reasonably possible. Because many items are customized, colors, print placement, finish, and on-screen previews may vary slightly from the final product.

You are responsible for reviewing all names, phone numbers, email addresses, URLs, artwork, spelling, branding, and programming information before approving or submitting an order. You must also have the rights or permissions needed for any content, logo, image, text, or link you ask us to use.

4. Quotes, pricing, and payment

• Prices are usually shown in AED and may change before an order is accepted.
• VAT or other applicable charges may be added where required by law.
• Orders may require full or partial prepayment before design, programming, production, or dispatch begins.
• We may refuse or cancel an order if pricing, stock, customization instructions, delivery details, or payment information are incomplete, inaccurate, or suspicious.

5. Order acceptance and production

An enquiry, cart, quote, or payment request does not automatically mean every order has been accepted. An order is generally accepted once we confirm it or begin processing it. For customized products, production may start as soon as artwork, profile details, or other specifications are approved or submitted.

6. Shipping, delivery, and inspection

Delivery dates are estimates unless we expressly agree otherwise in writing. Courier delays, customs issues, force majeure events, and address errors can affect delivery timing. Please inspect your order promptly after receipt and report any visible delivery damage, wrong-item issue, or manufacturing defect as soon as possible.

7. Cancellations, returns, and refunds

Our Refund Policy forms part of these terms. Customized items generally cannot be cancelled, returned, or refunded once production, printing, engraving, or programming has started, subject always to any mandatory rights available under applicable law.

8. Digital profiles, dashboards, and user content

If we provide a dashboard, profile page, redirect service, or editable digital content, you are responsible for the content you publish through it and for keeping login details confidential. You must not upload or publish unlawful, defamatory, misleading, infringing, malicious, or harmful content.

We may suspend or remove content or access where reasonably necessary to protect users, comply with law, respond to complaints, or protect our systems and reputation.

9. Intellectual property

The website, our branding, page designs, product copy, graphics, photos, code, and other original materials are owned by or licensed to Smaacaad and are protected by applicable intellectual property law. These terms do not transfer any ownership rights to you except for the limited right to use the website for legitimate business or consumer purposes.

You retain ownership in materials you lawfully provide to us, but you give us a non-exclusive permission to use, reproduce, adapt, and process those materials as needed to quote, design, manufacture, program, deliver, and support your order.

10. Third-party services

Some products or pages may rely on third-party payment processors, couriers, social platforms, map services, or linked websites. We are not responsible for the content, terms, outages, or privacy practices of third-party services, though our own obligations to you under applicable law still remain where required.

11. Warranty and product performance

We aim to supply products that materially match the order description and function as reasonably expected when used correctly on compatible devices. NFC performance can be affected by phone settings, third-party app behavior, tag placement, environmental conditions, or misuse. Unless a separate written warranty applies, we provide the website and related digital services on an "as available" basis.

12. Limitation of liability

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, or rights that mandatory consumer law gives you.

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, punitive, or consequential loss, loss of profit, loss of reputation, or loss of data arising from your use of the website or products. Our total liability for a claim relating to a product or service will generally not exceed the amount you paid us for the specific order giving rise to the claim.

13. Suspension and termination

We may suspend access to the website, cancel an order, or refuse service where reasonably necessary for security, fraud prevention, legal compliance, non-payment, abusive behavior, or breach of these terms.
